These Terms and Conditions (“Terms”) govern your use of the services provided by Youbeya LLC(“Youbeya,” “we,” “us,” or “our”) through our website at www.youbeya.com and related services. By accessing or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Services

Youbeya LLC provides web hosting, VPS, VDS, dedicated server, managed server, custom software development, and technical support services (“Services”). All Services are subject to availability, and we reserve the right to modify, suspend, or discontinue any Service at any time with reasonable notice.

2. Order and Agreement

All orders are currently placed through WhatsApp communication with our team. An order is confirmed only when you receive a written confirmation from a Youbeya representative. By placing an order, you agree to these Terms and any specific conditions communicated at the time of purchase.

3. Payment

Payment terms, accepted methods, and due dates are communicated to you at or before the time of order confirmation. Failure to pay on time may result in suspension or termination of Services. Youbeya reserves the right to update pricing with at least 30 days’ notice for recurring services.

4. Acceptable Use

You must not use Youbeya services to:

  • Distribute malware, viruses, or any malicious code
  • Launch denial-of-service (DoS/DDoS) attacks
  • Send unsolicited communications (spam)
  • Host or distribute illegal content
  • Infringe on the intellectual property rights of others
  • Engage in any activity that violates applicable local, national, or international law
  • Resell our services without prior written authorization

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.

5. Service Levels and Uptime

Youbeya targets 99.9% uptime for hosting and server services. Scheduled maintenance windows will be communicated in advance where reasonably practicable. Youbeya does not guarantee uninterrupted service and shall not be liable for unavailability caused by factors beyond our reasonable control, including but not limited to natural disasters, upstream network failures, or force majeure events.

6. Client Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Keeping your contact and billing information accurate and up to date
  • Ensuring your use of the Services complies with these Terms and applicable law
  • Maintaining your own independent backups of your data

7. Intellectual Property

All content, trademarks, and intellectual property on this website are owned by or licensed to Youbeya LLC. For custom development projects, the client receives ownership of the deliverables upon full payment, unless otherwise agreed in writing. Any pre-existing Youbeya frameworks, libraries, or tools used in development remain the property of Youbeya.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Youbeya LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or business interruption. Youbeya’s total liability for any claim shall not exceed the amount paid by you in the three months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Youbeya LLC, its directors, officers, employees, and agents from and against any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.

10. Termination

Either party may terminate the service agreement with reasonable written notice. Youbeya may terminate immediately if you breach these Terms in a material way. Upon termination, you remain responsible for any outstanding balances. Refund eligibility is subject to our Refund Policy.

11. Privacy

Our collection and use of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Governing Law and Disputes
